Privacy Policy

This Privacy Policy describes how Trade Tracker LLC ("Company," "we," "us," or "our") collects, uses, discloses, and safeguards personal information in connection with our web-based trading journal application and related services (the "Services").

This Policy applies to users located in the United States and, where applicable, to users in other jurisdictions.

1. Information We Collect

We collect the following categories of personal information:

A. Information You Provide Directly

Name; email address; billing information (processed via third-party payment processor); trade records uploaded via broker CSV files; journal entries, portfolio information, performance metrics, and other trading-related data you upload to the platform; trading strategies, preferences, goals, and other customization settings you configure; chat messages within the platform; support inquiries and transcripts; and information submitted in connection with referral programs.

B. Automatically Collected Information

When you access the Services, we may automatically collect: IP address; device type, browser information, operating system, and screen resolution; usage data including pages visited, features used, time spent on the platform, and interaction with AI features; server logs, error reports, and access times; and cookies and similar tracking technologies.

C. Payment Information

Payments are processed through Stripe. We do not store full credit card numbers or raw payment card data on our servers. We receive only limited payment information from Stripe (last 4 digits, card brand, expiration date) to manage your subscription and billing. Stripe collects and processes payment information according to Stripe's Privacy Policy.

D. Information from Third Parties

If you sign in through Google, Apple, or other third-party authentication services, we receive basic profile information. We also receive aggregated usage statistics from analytics providers.

2. How We Use Information

We use personal information to: provide, operate, and maintain the Services; process subscriptions and payments; enable trade journal functionality; generate AI-powered insights based on trade data; respond to customer service inquiries; administer referral programs; send marketing communications (you may opt out at any time); send billing and payment-related notifications (failed payments, upcoming renewals, receipts); monitor usage and improve performance; detect fraud, abuse, or security incidents; enforce our Terms of Service; and comply with legal obligations.

3. AI-Generated Insights

The Services may use artificial intelligence or automated systems to analyze uploaded trade data and generate insights. These insights are informational only, do not constitute financial advice, and do not produce automated decisions with legal or similarly significant effects. We do not engage in automated decision-making that materially affects user rights.

We may use anonymized, aggregated data derived from your trading data to train and improve our AI and machine learning models used in connection with the Services. Your individual trades and account data are never shared or used in identifiable form for any of these purposes.

4. Cookies and Analytics

We use cookies and similar technologies for functionality and analytics. We use Google Analytics to understand usage patterns and improve our Services. You may adjust browser settings to refuse cookies; however, some features may not function properly.

Marketing emails are distributed via MailerLite, and you may unsubscribe at any time.

5. Publicly Shared Trade Data

The Services include optional community and social features that allow you to share trades and related content publicly with other users. If you choose to use these features, please be aware that:

Content you voluntarily share publicly is visible to other users of the Service and is treated differently from your private journal entries and trade data. Publicly shared content is subject to the broader license described in our Terms of Service and may be used by Trade Tracker to operate, display, and improve the community features of the Service. We recommend you do not include sensitive personal or financial information in any content you choose to share publicly. You can return shared content to private status at any time through your account settings, though content already viewed or interacted with by other users cannot be retroactively removed from their experience.

Your private journal entries, trade data, and account information are never made visible to other users without your explicit action.

6. How We Share Information

We do not sell personal information. We may share information with: hosting providers; payment processors (Stripe); email and communication providers; analytics providers; service providers assisting in business operations; and legal authorities if required by law.

All service providers are contractually obligated to protect personal information.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction.

We may share anonymized, aggregated data that cannot identify you individually for research, marketing, or analytical purposes.

7. Data Retention

We retain personal information as follows:

Account and trade data: Until account deletion. Billing records: As required for tax and accounting purposes. Usage logs: Up to 12 months. Marketing data: Until you unsubscribe. Backup data: Rolling 30-day retention.

Upon account cancellation, data is retained for up to 30 days and then deleted, except where longer retention is legally required.

Note: Stripe retains payment card information according to their data retention policies and PCI-DSS requirements. We do not control Stripe's retention of your payment information.

8. Data Security

We implement reasonable administrative, technical, and organizational safeguards, including: encryption in transit (TLS); password hashing; access controls; and secure hosting infrastructure.

No system can be guaranteed 100% secure. Users are responsible for safeguarding their account credentials.

9. Security Incidents

In the event of a security incident involving personal information, we will investigate promptly and notify affected individuals as required by applicable law.

10. Your Privacy Rights (United States)

Depending on your state of residence, you may have the right to: request access to personal information; request correction of inaccurate information; request deletion of personal information; request data portability; and opt out of certain types of data sharing (if applicable).

We do not sell personal information.

To exercise your rights, contact us at privacy@tradetracker.ai. We may verify your identity before processing requests.

You may opt out of marketing emails using the unsubscribe link in any marketing message or by managing email preferences in your account settings. You will still receive transactional emails (receipts, security alerts, etc.).

Some browsers have a "Do Not Track" feature. Currently, we do not respond to Do Not Track signals due to the lack of industry standards.

11. California Privacy Disclosures

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), as amended by the CPRA, including the right to know, delete, correct, and limit certain uses of personal information.

We do not sell or share personal information for cross-context behavioral advertising.

12. International Users

While our Services are primarily intended for users located in the United States, individuals located in the European Economic Area (EEA), United Kingdom, or other jurisdictions may have additional rights under applicable data protection laws.

Where required, we process personal data based on: performance of a contract; legitimate interests; consent; and compliance with legal obligations.

If you are located in the EEA or UK, you may have the right to: access your data; request correction; request erasure; restrict processing; object to processing; and request data portability.

We may transfer personal data outside your jurisdiction, including to the United States. Where required, we rely on appropriate safeguards, including contractual protections.

If applicable law requires us to appoint a representative in your jurisdiction, we will do so.

13. Children's and Underage Users' Privacy

The Services are intended for users who are at least 18 years of age, consistent with our Terms of Service eligibility requirements. The Services are not directed to individuals under 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it promptly. If you believe we have collected information from someone under 18, please contact us at privacy@tradetracker.ai.

In particular, we do not knowingly collect personal information from children under 13 as defined by the Children's Online Privacy Protection Act (COPPA). If you believe a child under 13 has provided us with personal information, please contact us at privacy@tradetracker.ai and we will take immediate steps to delete such information.

14. Changes to This Policy

We may update this Privacy Policy periodically. For material changes, we will provide at least 30 days' advance notice by email to the address associated with your account or by posting a prominent notice through the Service before the changes take effect. Non-material changes will be posted with a revised "Effective Date" and take effect immediately. Your continued use of the Services after any changes become effective constitutes acceptance of the updated Privacy Policy. If you do not agree to the updated Policy, you must stop using the Services and cancel your account.
